1. Acceptance
By using Hoot5, you agree to these Terms. If you do not agree, please do not use the service.
2. Accounts
You must provide a valid email to create an account. You are responsible for keeping your login credentials secure. We may suspend accounts that violate these terms or cause harm to the platform or other users.
3. Passes and subscriptions
Hoot5 offers time-limited passes and an annual subscription. Passes unlock features for the purchased duration. The annual subscription auto-renews yearly unless cancelled. You can cancel anytime from your account settings.
4. Payments
All payments are processed via Stripe. We do not store full credit card numbers. Prices are listed in USD and may be subject to applicable taxes.
5. Refunds
See our Refund Policy for details. In short: if a technical issue prevented you from hosting, we refund within 7 days.
6. Acceptable use
Do not use Hoot5 for unlawful, abusive, or infringing purposes. Do not attempt to disrupt the service, scrape data, or impersonate others. We reserve the right to remove content and suspend accounts that violate this policy.
7. Content ownership
You own the quizzes you create. We may use anonymized gameplay data to improve the service. We do not sell your personal data.
8. Intellectual property
Hoot5's branding, code, and design are our property. You may not copy or reverse-engineer the service without permission.
9. Termination
You may delete your account at any time. We may terminate or suspend access for violations of these terms. Upon termination, your content may be deleted after a reasonable grace period.
10. Disclaimer of warranty
Hoot5 is provided “as is” without warranties of any kind. We do not guarantee uninterrupted or error-free service.
11. Limitation of liability
To the fullest extent permitted by law, Hoot5's liability is limited to the amount you paid us in the 12 months preceding the claim.
12. Governing law
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.
13. Changes to terms
We may update these Terms from time to time. We will notify you of material changes via email or in-app notice. Continued use after changes means you accept the updated Terms.
